1.1 In this policy, “we”, “us” and “our” refer to Colihan Consulting, LLC.
1.2 We value your privacy, and are committed to safeguarding the privacy of our website visitors and service users.
1.3 This policy applies where we are acting as a data controller with respect to the personal data of our website visitors and service users; in other words, where we determine the purposes and means of the processing of that personal data.
1.5 We will never sell, trade, or divulge your e-mail address or any other personal information you may share with us. We firmly believe that the disclosure of personally identifiable information should occur only with your express permission, and intend to operate this site in accordance with this.
2.1 We have asked our web hosting company to be sure it is taking prudent measures against unauthorized access to the information you give us by employing administrative, technical, and physical safeguards to protect against misuse, disclosure, destruction, or unauthorized access.
2.2 While no computer system can ever be totally protected, we believe our web hosting company is taking reasonable steps to safeguard your information.
3.1 Confidentiality. In order for us to perform consulting services, it may be necessary for you to provide us with Confidential Information (as defined below) regarding your business and products. You will rely heavily upon our integrity and prudent judgment to use this information only in your best interests.
3.2 Participant responses will be used to conduct wellness research, provide aggregate reports (minimum of 10 participants included to protect participant anonymity), and provide trending information for follow-up assessments on your organization and we may use participant responses to contribute to wellness research and benchmarking data (which includes responses from over 2,800 working-age adults in the United States as of 15 Jan 2019) and as such all intellectual property generated under this Agreement shall remain the property of Colihan Consulting. We will handle client organization reports confidentially, providing such reports only to the individuals named in this document or their personally designated agents.
3.3 Obligation of Confidentiality. In performing consulting services under this Agreement, we may be exposed to and will be required to use certain “Confidential Information” (as hereinafter defined) by you. We agree that we will not and our employees, agents, or representatives will not use, directly or indirectly, such Confidential Information for the benefit of any person, entity, or organization other than you, or disclose such Confidential Information without your written authorization, either during or after the term of this Agreement, for as long as such information retains the characteristics of Confidential Information.
3.4 Definition. “Confidential Information” means information not generally known and proprietary to you or to a third party for whom you are performing work, including, without limitation, information concerning any patents or trade secrets, confidential or secret designs, processes, formulae, source codes, plans, devices or material, research and development, proprietary software, analysis, techniques, materials, or designs (whether or not patented or patentable), directly or indirectly useful in any aspect of your business, any vendor names, customer and supplier lists, databases, management systems and sales and marketing plans of yours, any confidential secret development or research work of yours, or any other confidential information or proprietary aspects of the business of yours.
